Welcome to Nextsulting LLC (“Nextsulting,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of https://nextsulting.com (the “Service”).

1. Overview

Nextsulting provides digital marketing, web development, advertising, and reputation management services. By engaging with our services, you agree to abide by these Terms, which are subject to periodic updates. Any modifications will be communicated, and continued use of our services constitutes acceptance of the revised Terms.

2. Subscription & Billing

2.1 Subscription Services

Certain services are provided on a subscription basis (“Subscription(s)”). Subscription fees are billed in advance per the selected monthly or annual billing cycle.

  • Your Subscription automatically renews unless canceled before the next billing cycle.
  • You can cancel or modify your Subscription by contacting our customer support team or through your account management portal.

2.2 Payments & Fees

  • A valid payment method (credit card, PayPal, ACH, etc.) is required for all transactions.
  • If automatic payment fails, an invoice will be issued, and payment must be completed manually by the due date.

2.3 Price Adjustments

We reserve the right to adjust pricing at any time, with at least 30 days’ notice for active Subscriptions. Continued use after a pricing update constitutes agreement to the new rates.

3. Refunds & Cancellations

  • Refunds are not guaranteed and are evaluated on a case-by-case basis at Nextsulting’s sole discretion.
  • Clients may cancel Subscriptions at any time, but no prorated refunds will be provided for unused service periods.

4. Account & Security Responsibilities

4.1 Account Management

  • Users must provide accurate, complete, and updated information when creating an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • Any unauthorized access or security breaches must be reported immediately.

4.2 Access Management & Security Compliance

All requests for access to social media, websites, Google Business Profiles, and digital assets must follow our Access Management Policy to ensure compliance and security.

  • Multi-Factor Authentication (MFA) where applicable.
  • Restricted permissions to ensure only authorized users have access.
  • Security logging of all access modifications.

Nextsulting reserves the right to deny or revoke access if proper authorization is not provided.

5. Intellectual Property & Copyright

5.1 Ownership

All content, software, and materials provided by Nextsulting are owned by Nextsulting or licensed for use. Unauthorized copying, distribution, or modification is prohibited.

5.2 Copyright Policy

If you believe your intellectual property has been infringed upon, please contact us immediately at [email protected] with a DMCA request.

Your request must include:

  • A detailed description of the infringing material.
  • Proof of ownership or authorization.
  • Your contact information and a signed statement confirming the accuracy of your claim.

7. Limitation of Liability & Indemnification

7.1 No Warranty

Nextsulting provides services on an “as-is” basis. We do not guarantee:

✅ Security of data once access is transferred.
✅ Compatibility with all hosting providers for website migrations.

7.2 Liability Limits

To the fullest extent allowed by law, Nextsulting LLC, its affiliates, and employees are not liable for:

  • Loss of profits, data, or business due to service interruptions.
  • Unauthorized access or misuse by third parties.
  • Delays or disputes related to access requests.

7.3 Indemnification

You agree to defend, indemnify, and hold harmless Nextsulting LLC from any claims, damages, or legal disputesarising from your use of our services.

8. Termination & Suspension

Nextsulting reserves the right to terminate or suspend services at any time if:

  • A breach of these Terms occurs.
  • A security risk is identified.
  • Billing issues or non-payment arise.

9. Governing Law & Dispute Resolution

These Terms are governed by the laws of Illinois, USA. Any disputes will be resolved through binding arbitration in Illinois, unless otherwise required by law.

10. Changes to These Terms

We may update these Terms at any time, with at least 60 days’ notice for significant changes. Continued use of our services after updates constitutes acceptance.
